The Challenge
The leadership team approached Rinew Legal at the outset of a highly sensitive situation involving the suspension, investigation and disciplinary process of a senior individual.
This wasn’t a typical employment issue. The individual was also a Managing Director, shareholder and statutory director, meaning the situation crossed into corporate governance and shareholder considerations as well as employment law.
For the leadership team, the issue quickly became complex.
It involved someone at the very top of the organisation, carried clear reputational risk and created a level of internal disruption the business had never experienced before. At the same time, the company was continuing to grow and the leadership team needed to stay focused on running the business.
Handling the process incorrectly could have create significant financial exposure. From an early stage, it was anticipated that the situation could lead to an unfair dismissal claim in the Employment Tribunal.
The business needed clear guidance, reassurance and structural approach to navigating an unfamiliar and high-stakes situation.
Our Role

Because we had been involved throughout the earlier stages, we already had a detailed understanding of the evidence and the reasoning behind the decisions that had been taken. This preparation was critical once the matter moved into formal litigation.
The case itself was substantial. It involved a tribunal bundle of more than 2,000 pages, complex senior-level issues and an aggressive litigant.
Our role was to manage the litigation while continuing to support the leadership team behind the scenes, ensuring the case was thoroughly prepared and the business remained focused on its day-to-day operations.
